1. Scope

These General Terms and Conditions apply to all rental agreements for the holiday accommodations offered on the website www.keyforest-homes.com (as well as www.keyforest-homes.de), concluded between KeyForest Homes – Owner Pierre Dreyer (hereinafter "the Lessor") and the guest (hereinafter "the Guest").

2. Conclusion of Contract

The presentation of accommodations on the website does not constitute a legally binding offer, but rather a non-binding invitation to make a booking. By completing the online booking form and successfully completing the payment process, the Guest submits a binding offer. The rental contract is concluded upon receipt of the automatic booking and payment confirmation by email to the Guest.

3. Prices and Payment Terms

All stated prices are total prices including statutory VAT and the final cleaning fee.

Payment is processed directly during the booking process through the payment service provider Stripe (supported payment methods: Credit Card, Apple Pay, Google Pay, PayPal). Upon successful booking, the total amount is charged immediately.

If payments are not completed successfully or are charged back, the Lessor is entitled to withdraw from the contract and rent the accommodation to another party.

4. Arrival and Departure

The holiday accommodation is available to the Guest on the day of arrival from 15:00. On the day of departure, the accommodation must be vacated in a swept-clean condition and properly handed over or locked by no later than 10:00. Deviating check-in or check-out times require prior written agreement with the Lessor.

5. Cancellation by the Guest

The Guest may withdraw from the rental contract at any time before the start of the stay. The withdrawal must be declared in text form (e.g., by email to welcome@keyforest-homes.de) to the Lessor. The time of receipt of the declaration by the Lessor is decisive.

In the event of cancellation, the Lessor is entitled to reasonable compensation, structured as follows:

  • Cancellation up to 60 days before check-in: free of charge (100% refund)
  • Cancellation from the 59th to the 30th day before check-in: 50% of the total price
  • Cancellation from the 29th to the 7th day before check-in: 80% of the total price
  • Cancellation from the 6th day before check-in or in case of no-show: 90% of the total price

The Guest reserves the right to prove that the Lessor has incurred no loss or a significantly lower loss.

We recommend that all Guests take out private travel cancellation insurance.

6. Exclusion of the Right of Withdrawal

We expressly point out that for rental agreements for holiday accommodations concluded for a specific date or period, there is no statutory right of withdrawal.

Pursuant to § 312g(2) Sentence 1 No. 9 BGB (German Civil Code), the provisions on distance selling contracts (and the associated right of withdrawal) are not applicable to contracts for the provision of accommodation services for purposes other than residential purposes, if the contract provides for a specific date or period for performance. This means that your booking is legally binding upon receipt of the booking confirmation and the cancellation conditions set out in Section 5 apply.

7. Guest Obligations

The Guest undertakes to treat the accommodation and its inventory with care. Any damage occurring during the stay must be reported to the Lessor immediately. The Guest is liable for all damages caused by them or their travelling companions.

The accommodation may only be occupied by the number of persons specified in the booking. Pets and smoking inside the premises are not permitted unless expressly approved in writing in advance.

8. Liability and Governing Law

The Lessor is liable for the proper provision of the rental property. Liability for material and financial damages is limited to intent and gross negligence, unless it concerns the breach of essential contractual obligations or damages resulting from injury to life, body, or health. The law of the Federal Republic of Germany applies. The place of jurisdiction for all disputes arising from this contractual relationship is the Amtsgericht Lörrach (Local Court of Lörrach).
